Individuals sometimes do things that they know will violate the terms of a statute. Most scholars deny that such actions are always morally wrong, but a coherent theoretical account of the relationships between 1) moral obligation, 2) legal obligation, and 3) criminal wrongdoing that can robustly classify hard cases has been elusive. This article starts with a Kantian account of the relationship between law and morality, and it proposes two closely related standards: one for legal obligation, and another for criminal (...) wrongdoing. It then tests the plausibility and resilience of these standards by using them to generate illuminating new analyses of classic hypothetical cases involving alleged crimes committed under circumstances of necessity. These analyses offer reason to believe that the standards proposed in this article can anchor a Kantian theory of criminal responsibility that is simultaneously rigorous and humane. (shrink)

Rescher has presented a proof that a completed science is logically impossible; not every truth can be known. I show that the proof is valid only if it is read de re. One of its premises, however, is an obvious truth only on a de dicto reading; read de re it is false. What the proof shows, therefore, is that science has no limits and any true proposition can be known. We can, however, know it only in the meagre de (...) re, and not in the informationally rich de dicto, sense of 'know'. (shrink)

In this concluding reflection, the editors of this special issue reflect on the significance that Heidegger has had for French philosophy, precisely because of the creative and critical engagement of many of the original thinkers demonstrated above. It is not insignificant that Christian thinkers were drawn to Heidegger, seeing promise in his expansion of philosophical questioning, above all an enrichment of the idea of truth. However it is equally important to recognize that Heidegger’s native Christian roots were stripped of their (...) animating spirit, the question of God and the revelation of the Hebraic scriptures. It is thus notable that the criticisms from this conference originating from the side of faith frequently appeal to the Scriptures as they argue that there are truths which Heidegger himself simply does not seem to see. In this note, an error in the axiomatization of Ivlev’s modal system Sa+ which we inadvertedly reproduced in our paper “Finite non-deterministic semantics for some modal systems”, is fixed. Additionally, some axioms proposed in were slightly modified. All the technical results in which depend on the previous axiomatization were also fixed. Finally, the discussion about decidability of the level valuation semantics initiated in is taken up. The error in Ivlev’s axiomatization was originally pointed out by H. Omori and D. Skurt (...) in the paper “More modal semantics without possible worlds”, where an alternative solution was proposed. (shrink)

Reply to Professor Martinich The editor of this journal has invited me to reply to Professor Martinich's reply to my reply to his reply to my article, on the condition that I should be brief. I shall try to be very brief. Our discussion has probably reached a point at which we can expect dimin- ishing returns. I shall try also to avoid even the slightest hint of irony, though I am not sure I can succeed in that. I am (...) surprised that Prof. Martinich, who sees so little irony in Hobbes, should find so much in "Calvin and Hobbes." I did think his definition of "orthodoxy" was plausible, taking the term "plausible" in the sense of "having an appearance or show of truth, reasonableness or worth" . That's also, of course, perfectly consistent with thinking the criterion of the creeds too weak. The Church of England, from the time of Elizabeth, has made acceptance of the Nicene and Aposdes' Creeds one of the 39 Articles which define membership in that Church. But Martinich exaggerates when he says that that was the criterion of orthodoxy used by the Church. The 39 Articles cover many other issues as well, including God's incorpo- reality. As a somedme member of that Church, I wonder if Martinich has given thor- ough consideration to all that it requires of its adherents. I welcome Martinich's clarification of his use of the term "Calvinist." It was silly of me to think that he intended it to imply.. (shrink)

Let T 1 , T 2 be countable first-order theories, M i ⊨ T i , and ������ any regular ultrafilter on λ ≥ $\aleph_{0}$ . A longstanding open problem of Keisler asks when T 2 is more complex than T 1 , as measured by the fact that for any such λ, ������, if the ultrapower (M 2 ) λ /������ realizes all types over sets of size ≤ λ, then so must the ultrapower (M 1 ) λ /������. (...) In this paper, building on the author's prior work [12] [13] [14], we show that the relative complexity of first-order theories in Keisler's sense is reflected in the relative graph-theoretic complexity of sequences of hypergraphs associated to formulas of the theory. After reviewing prior work on Keisler's order, we present the new construction in the context of ultrapowers, give various applications to the open question of the unstable classification, and investigate the interaction between theories and regularizing sets. We show that there is a minimum unstable theory, a minimum TP 2 theory, and that maximality is implied by the density of certain graph edges (between components arising from Szemerédi-regular decompositions) remaining bounded away from 0, 1. We also introduce and discuss flexible ultrafilters, a relevant class of regular ultrafilters which reflect the sensitivity of certain unstable (non low) theories to the sizes of regularizing sets, and prove that any ultrafilter which saturates the minimal TP 2 theory is flexible. There have been two main lines in the literature on restricted games: the first line was started by Myerson (1977) that studied graph-restricted games an the second one was initiated by Faigle (1989). The present paper provides a unified way to look on the literature and establishes connections between the two different lines on restricted games. The strength and advantages of this unified approach becomes clear in the study of the inheritance of the convexity from the game to the restricted (...) game where an interesting result by Nouweland and Borm (1991) on the convexity of graph-restricted games is turned into a direct consequence of the corresponding result by Faigle (1989), by means of this relation. Whooping cough is a highly transmitted disease around the world. According to the World Health Organization, 0.15 million cases had reported globally in 2018. Most of the Asian and African states are infected regions. Through the study, we investigated the whole population into the four classes susceptible, exposed, infected, and vaccinated or recovered. The transmission dynamics of whooping cough disease are studied analytically and numerically. Analytical analyses are positivity, boundedness, reproduction number, equilibria, and local and global stabilities. In numerical analysis, (...) we developed an implicit numerical integration scheme consistent with the biological problem’s properties. The analysis of the implicit method for the said model is dynamically consistent, positive, and bounded. Furthermore, an implicit numerical integration scheme is suitable for studying a particular epidemic model such as the whooping cough disease. (shrink)

Bacteria have evolved advanced strategies for surviving during nutritional stress, including expression of specialized enzyme systems that allow them to grow on unusual nutrient sources. Inorganic phosphate (Pi) is limiting in most ecosystems, hence organisms have developed a sophisticated, enzymatic machinery known as carbon‐phosphorus (C‐P) lyase, allowing them to extract phosphate from a wide range of phosphonate compounds. These are characterized by a stable covalent bond between carbon and phosphorus making them very hard to break down. Despite the challenges involved (...) in both synthesizing and catabolizing phosphonates, they are widespread in nature. The enzymes required for the bacterial C‐P lyase pathway have been identified and for the most part structurally characterized. Nevertheless, the mechanistic principles governing breakdown of phosphonate compounds remain enigmatic. In this review, an overview of the C‐P lyase pathway is provided and structural aspects of the involved enzyme complexes are discussed with a special emphasis on the role of ATP‐binding cassette (ABC) proteins. The sudden emergence of the COVID-19 pandemic brought global disruption to every aspect of society including healthcare, supply chain, the economy, and social interaction. Among the many emergent considerations were the safety and public health of the public, patients, essential workers, and healthcare professionals. In certain locations, clinical research was halted—or terminated—in deference to the immediate needs of patient care, and clinical trials focusing on the treatment and prevention of coronavirus infection were prioritized over studies focusing on other diseases. Difficult (...) decisions were made rapidly; flexibility and reconsideration were necessary not only because the intensity and severity of infection varied over time and by locale but also because knowledge of the disease and understanding of its treatment grew. Here we discuss the ethical challenges in decision-making and competing ethical tensions during the pandemic in an effort to advance future preparedness. (shrink)

ARE HUMAN beings material substances? If not, are they made of material stuff? And is the world otherwise materialistic? These are ancient questions for which the dominant intellectual framework of our age compels us toward affirmative answers. In this paper, I want to reinterpret the questions, critically examine the currently most popular way of making the case for the affirmative answers, and argue for a somewhat novel way of casting negative answers in search of a more adequate philosophical understanding of (...) human beings, minds, and persons.
